Insurance: Stumpmaster holds comprehensive public liability insurance for damage to persons or property that may result in the implementation of this contract.
Quotation: the quotation will be valid for 30 days, unless otherwise agreed or stated
Cancellation Fee: Stumpmaster requests that the authorizing party provide at least 24 hours advance notice of any full or partial work cancellation for jobs that have been scheduled in advance. If a crew has been dispatched to the job site, the customer will be charged a mobilization fee of $100+GST for incurred expenses.
Completion of Contract: Stumpmaster agrees to do its best to meet any agreed completion dates, but will not be liable for damages or otherwise for delays; nor shall the customer be relieved of completion for delays.
Tree Ownership: The authorizing party warrants that all trees listed are located on the customer’s property, and, if not, that full permission, in writing, has been granted by the owner to allow Stumpmaster to perform the specified work. Should any tree be mistakenly identified as to ownership, the customer agrees to indemnify Stumpmaster for any damages or costs incurred as a result thereof.
Private Covenants/Previous Resource Consents: Investigation of any private covenants or previous resource consent conditions is the sole responsibility of the client and no liability shall be attached to the contractor for breach of the covenant or consent conditions.
Safety: Stumpmaster warrants that all arboricultural operations will follow the latest version of the best practice guideline as outlined by the New Zealand Arboriculture Association. The authorising party agrees not to enter the work area during arboricultural operations unless authorized by the crew leader on-site.
Stump Removal: Unless otherwise stated, stump removal is not included in the price quoted. Unless otherwise stated, stumps that are ground will be taken 100mm below ground level. Grindings from stump removal are left on site unless otherwise arranged. Surface and subsurface roots beyond the stump are not removed unless otherwise stated.
Logs/Firewood: The term “Firewood” refers to logs no smaller than 9” diameter which can be cut into rings, left in log form or removed from site. If firewood or logs are not mentioned in this proposal they will be removed from site. For health and safety reasons no wood smaller than 9” diameter can be cut into rings.
Incurred Costs After Acceptance: If any costs are incurred through required arrangements with external organisations after acceptance, the authoriser agrees to reimburse Stumpmaster for these costs, if work is not completed due to cancellation.
Concealed Contingencies: Any additional work or equipment required to complete the work, caused by the authorizing party’s failure to make known or caused by previously unknown foreign material in the trunk, the branches, underground, or any other condition not apparent at the time of quoting, shall be paid for by the customer on a time and material basis.
Underground Services: All carer will be taken to avoid damage, however, Stumpmaster accepts no liability for repairs to underground services, sprinklers or similar if damage occurs as a result of work.
Driveways/Sidewalks: Stumpmaster will attempt to minimize any damage to footpaths and driveways. However, in the event that our equipment causes settling, cracking, or other damage to footpaths and/or driveway, then repairs are not included in the contract price.
Clean-up: Clean-up shall include removing wood, brush, and raking of the area affected by the specified work, unless noted otherwise on this proposal.
Lawn Repair: Stumpmaster will attempt to minimize any disturbance to the customer’s lawn. Lawn repairs are not included in the contract price, unless noted otherwise on this proposal.
Bartercard: Unless specified in this quotation payment by Bartercard is not accepted.
Complaints: Any complaints which may arise from work performed must be made within seven (7) days from the date of invoice, unless otherwise agreed in writing.
Terms of Payment: Unless otherwise noted in this proposal, the customer agrees to pay the account in full within the time stated on the invoice. Failure to remit full payment within the payment term will result in a finance charge of 5.00% per month or part month. Any expenses, disbursements and legal costs incurred by Stumpmaster in recovering unpaid invoices shall be paid by the client.
Returned Cheque Fee: There will be a $25.00 fee charged for all cheques returned to our office for non-sufficient funds.
